… will be received by the City Clerk in the City Clerk’s Office, Batavia City Hall at One City Centre, Batavia, New York on or before 10:00am local time on the 21st day of November, 2023 at which time they will be opened and read aloud in the Council Chambers, Batavia City Hall at One City Centre, Batavia, New York, 14020.
Each Bidder is instructed that at the time of bid submission as described above, each bid shall be submitted in a sealed envelope that is clearly marked with one of the five (5) prime contract names also referenced above. If a bidder intends to submit bids for more than one prime contract, each bid proposal must be submitted in a separate sealed envelope, each with the appropriate prime contract name clearly marked.
Bidding Documents may be viewed and ordered through the Issuing Office website at – www.avalonroch-planroom.com/ in the “Public Jobs” section. If you do not have internet access or have questions on ordering from the site, please contact Avalon Documents Services at 585-242-9999. Drawings and Specifications can be picked up at any of Avalon Document Services’ locations:
1. For a non-refundable fee of Forty-Five Dollars ($45.00), interested entities may request and receive an Electronic Download of the Bidding Documents.
2. For a non-refundable fee of Ten Dollars ($10.00), interested entities may request and receive a CD with electronic copies of the Bidding Documents. If the CD is to be shipped, the Bidder must furnish Avalon with the Bidder’s active UPS or Federal Express account number or pay Avalon for all shipping and handling costs.
3. For a non-refundable fee, printed copies of the Bidding Documents may be obtained from any Avalon Planroom. If the documents are to be shipped, the Bidder must furnish Avalon with the Bidder’s active UPS or Federal Express account number or pay Avalon for all shipping and handling costs.
The Bidding Documents must be obtained through the Avalon Planroom in order to be considered a “Plan Holder of Record”. Bidding Documents obtained from any other source are for examination only, are not considered complete, and are not valid for
bidding purposes. The designated website will be updated periodically with addenda, lists of registered plan holders, reports, and other information relevant to submitting a Bid for the Project. All official notifications, addenda, and other Bid Documents will be offered only through the designated website. Neither the Owner nor Architect/Engineer will be responsible for Bid Documents, including addenda, if any, obtained from sources other than the designated website.
Bid Documents may be examined at the office of the Batavia City Clerk (at One Batavia City Hall, One City Centre, Batavia, New York 14020) and the offices of Ashley McGraw Architects, DPC (at 125 East Jefferson Street, 15th Floor, Syracuse, New York 13202) between the hours of 8:30am and 4:00pm daily except Saturdays, Sundays, and Holidays. Bid Documents will not be available from the City of Batavia or Ashley McGraw Architects, DPC.
A Pre-Bid meeting for interested Bidders is scheduled for Tuesday, NOVEMBER 7th, 2023, at 10:00 a.m. in the Council Chambers, Batavia City Hall at One City Centre, Batavia, New York, 14020. Representatives of the Owner and Architect/Engineer will be present to discuss the Project. Immediately following the Pre-Bid Meeting, an opportunity will be provided to visit the Project Site.
Prospective Bidders are advised that the City of Batavia encourages the participation of minority-owned, women-owned, veteran-owned, and service-disabled veteran-owned business enterprises in construction, supplier, equipment, and other related products and services.
The City of Batavia is exempt from the payment of sales and compensating use taxes of the State of New York and of cities and counties on all materials, equipment, and supplies sold to the City of Batavia pursuant to this Contract. Also exempt from such taxes are purchases by the Contractor and their Subcontractors/Vendors of materials, equipment, and supplies to be sold to the City of Batavia pursuant to this Contract, including tangible personal property to be incorporated in any structure, building, infrastructure, or other real property forming the parts of this Project. These taxes are not to be included in the Bid.
For all further requirements regarding bid submissions, qualifications, procedures, and contract award, refer to the Instructions to Bidders included within the Bid Documents.
Bids shall be made and received upon the following conditions:
Each Bid must be accompanied by the deposit of cash certified check, cashier’s check, or bid bond in an amount not less than five per centum (5%) of the total amount of the bid in the form provided, and subject to the conditions provided in the information and Instructions to Bidders.
The successful Bidder will be required to furnish a Performance Bond and Payment Bond, each in an amount equal to 100 percent (100%) of the total Contract award amount.
No bidder may withdraw their bid within (60) calendar days after the actual date of the opening thereof.
Each bidder’s attention is called to the General Municipal Law, which requires a bidder’s Certificate of Non-Collusion, copies of such certificates are part of the proposal form and unless complied with, the bid will not be accepted.
Upon acceptance of their bid, if the successful bidder fails to enter into a contract pursuant to the requirements of the Batavia City Council, or fails to give further security prescribed in this notice, within the time limited therein, then the check deposited as aforesaid and the monies standing to the credit of same, shall be forfeited to the City as liquidated damages, or the payment of the bond enforced for the benefit of the City. The City of Batavia reserves the right to waive informalities in, or to reject any and, all bids.
