CFTC Combined Synopsis/Solicitation number 9523ZY24Q0018



This is a combined synopsis/solicitation for commercial items and services, prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotations are being requested and a written solicitation will not be issued. CFTC intends to award a single purchase order to the Quoter whose quotation, conforming to this combined synopsis/solicitation, provides the Lowest Priced, Technically Acceptable (LPTA) solution.



The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2024-03, effective February 23, 2024. This procurement is being conducted as a full and open competition.



All responsible sources that are capable of providing Spectrum wired internet and wired television services to 290 Broadway STE 6th Fl, New York, NY may submit a quotation. The NAICS code for this acquisition is 517111 with a small business size standard of 1500 employees. The Government intends to award one purchase order resulting from this solicitation.



The contractor shall furnish the following items and services to the CFTC New York Regional Office, 290 Broadway STE 6th Fl, New York, NY:



*Fiber Internet - 1Gbps Up / 35Mbps Down. Associated Fiber Internet Services are the following:



**Unlimited Data – No data caps or excess usage fees



**24hr tech support



**Online Protection with Security Suite



**23 High Definition (HD) Television Receiver boxes



**Wifi not required



*Secure Fiber Optic Router and associated services:



**Advanced encryption strategies to safeguard sensitive and critical data,



**Monitoring system to physically monitor devices and cables.



**Limit access of the network to prevent unauthorized access.



**Static IP



*23 Cable Boxes and Spectrum Business TV



**HDMI HD Digital Receivers for all 23 boxes.



The period of performance will be one year from the effective date of award. All physical items shall be shipped F.O.B. Destination.



The provision at FAR 52.212-1, Instructions to Offerors-Commercial, applies to this acquisition. The following is incorporated into this solicitation as an addendum to FAR 52.212-1, which replaces section (f) of the provision:



"(f) Quotations received after the time and date specified in the solicitation will not be accepted unless the Contracting Officer determines that acceptance of the quotation is in the Government's best interest and will not unduly delay the acquisition."



The provision at FAR 52.212-2, Evaluation-Commercial Items, is applicable to this procurement. The specific evaluation criteria to be included in paragraph (a) of that provision are:



(1) Technical - The quoter shall provide a technical response indicating that it can provide the necessary Spectrum internet and television products and services described in this combined synopsis/solicitation. This response is limited a one (1) page. The Government will evaluate whether quoters can provide the necessary Spectrum internet and television services. To be considered acceptable, quoters must be able to provide all Spectrum services described in this combined synopsis/solicitation, to 290 Broadway STE 6th Fl, New York, NY.



(2) Past Performance - The quoter's history of successfully performing projects similar in scope to this project will be evaluated. CFTC will obtain past performance references directly from the Contractor Performance & Assessment Reporting System (CPARS, located at CPARS.gov) or other means as necessary. To be evaluated as acceptable, the information obtained through the CPARS.gov or other means must indicate a likelihood of successful performance. If CFTC is unable to obtain any corporate history of performing similar projects, a rating of “neutral” will be assigned. For the purposes of this evaluation, a “neutral” past performance rating will be considered acceptable.



(3) Price - The evaluated price will be the sum of the quoted price for all items and services listed in this combined synopsis/solicitation.



The Government intends to evaluate quotations and award a purchase order without discussions with quoters. CFTC will sort the quotes from the lowest to the highest overall evaluated price. CFTC will evaluate the quotes starting with the lowest overall price. Price is defined as the sum of all items and services listed in this combined synopsis/solicitation (i.e. Fiber internet and related services, Secure Fiber Optic Router and related services, Cable boxes and related service.)



Additional terms and conditions to be included in the purchase order are described in Attachment A to this solicitation.



The Brand-Name Justification for use of Spectrum services is Attachment B to this solicitation.



(1) Instructions for Price - Quoters shall provide a firm-fixed-price for all items and services described in this combined synopsis/solicitation for a one-year period of performance, with an anticipated start date of May 1, 2024.



CFTC expects to evaluate quotations and award a purchase order without conducting discussions and/or soliciting quotation revisions. Therefore, the quoter's initial quotation should contain the quoter's best terms from a price standpoint. However, CFTC reserves the right to conduct discussions if later determined by the CFTC Contracting Officer to be necessary. All questions regarding this combined synopsis/solicitation shall be submitted to the Contracting Officer via email to bvanwormer@cftc.gov, by 12:00 p.m. local (Washington, DC) time on April 3, 2024. CFTC expects, but does not guarantee, to answer questions submitted by this time. Questions, if answered, will be responded to in the form of an amendment to this combined synopsis/solicitation. Prospective quoters are warned against contacting any CFTC personnel other than the Contracting Officer prior to award of a purchase order resulting from this solicitation. If such a contact occurs and is found to be prejudicial to competing vendors, the vendor making such a contact may be excluded from award consideration. Quotations are due no later than 5:00PM local (Washington, DC) time on April 5, 2024. The quotations shall be submitted to the attention of Contracting Officer Benjamin Van Wormer via email to bvanwormer@cftc.gov.
