Project Description: The City University of New York (“CUNY” or the “University”) seeks a consultant (the “Contractor”) to provide the range of services detailed in the Scope of Work for this RFP to CUNY or any of the CUNY Constituent Colleges (collectively, for purposes herein, “CUNY”), on an as-needed basis, for the development and support of online education programs (each, a “Program”), referred herein collectively as “CUNY Online”.

The Scope of Work describes the anticipated set of services that CUNY will likely need during the Term. The service descriptions included herein provides an overview of the Services that CUNY may ask the Contactor to perform for any Program. This is a requirements contract, and CUNY will indicate the specific Service(s) in the Purchase Order that CUNY issues for that specific Program. CUNY does not guarantee any specific Services for any of the Programs.

The courses, which comprise each Program, will be delivered through CUNY’s learning management system environment.

Per Attachment 1 of the RFP, a Pre-Proposal Conference has been scheduled for Wednesday, October 26, 2022 at 11 AM EST. The Pre-Proposal Conference will be conducted via Zoom. The Procurement Lobbying Act (PLA) Applies to this Solicitation.

Compliance Procurement Lobbying Act
Required Forms: Vendor shall complete, sign and submit the following forms if they are selected.
1. “Offerer’s Affirmation of Understanding of and Agreement pursuant to State Finance Law § 139-j (3) and § 139-j (6) (b)”
2. “Offerer’s Disclosure of Prior Non-Responsibility Determinations and Certification of Compliance with State Finance Law §139-j and §139-k”.

Under the requirements of the State Procurement Lobbying Act all communications regarding advertised projects are to be channeled through the Office of the Executive Director of Strategic Sourcing and Chief Procurement Officer (*Designated Contacts). Until a designation is made, communication with any other CUNY employees concerning this project that is determined to be an attempt to influence the procurement may result in disqualification.

Contact with CUNY:
Under the requirements of the PLA, all communications regarding advertised projects are to be channeled through the Designated Contact. Communication with respect to this procurement initiated by or on behalf of an interested vendor through others than the Designated Contact may constitute an “impermissible contact” under NYS law
and could result in disqualification of that vendor.
