The Naval Air Systems Command (NAVAIR) intends to award a sole source, Firm Fixed Price (FFP) contract to BAE Systems, Information and Electronic Systems, (BAE) Greenlawn, NY for FY23-24 production requirements for the AN/UPX-50(C) Digital Interrogators (DI), as well as retrofit kits to upgrade older model DIs to the AN/UPX-50(C) configuration. The FY23 basic contract award will procure up to (33) DI and up to (34) retrofit kits; the FY24 Option will contain pricing for up to (32) DI and up to (63) retrofit kits. The quantities listed above are approximations and may be increased slightly if funding permits. BAE, as the sole designer, developer and manufacture of the AN/UPX-50(C) is the only company with the unique knowledge, experience, special skills, facilities, manufacturing techniques, and technical data required to perform these requirements. This acquisition is being pursued on a sole source basis under the statutory authority of 10 U.S.C 2304(c)(1), as implemented by Federal Acquisition Regulation (FAR) 6.302-1, “only one responsible source and no other supplies or services will satisfy agency requirements.” The Government does not intend to use the provisions of FAR part 12 for this acquisition.
